The Fort Worth Symphony Orchestra is hosting a special July 4th America Strong concert at the new Dickies Arena in Fort Worth. This performance will include guest artists from the Fort Worth Opera, The Cliburn, and Texas Ballet Theater, with a special appearance by Broadway star baritone and Fort Worth favorite Major Attaway. The concert will be broadcast by WFAA on Channel 8 at 9:00 PM on July 4, 2020. America Strong will also be available to watch on the FWSO’s website for two weeks following the event.

The Conductor

Miguel Harth-Bedoya

Esteemed Music Director Miguel Harth-Bedoya leads the FWSO, Vocalist Major Attaway, and guest artists from The Cliburn, Fort Worth Opera, and the Texas Ballet Theater in America Strong.

Major Attaway

Broadway Sensation and Fort Worth phenomenon, Major Attaway, will be the featured singer for America Strong.

The Cliburn

The 2013 Van Cliburn International Piano Competition Finalist Fei-Fei Dong returns to Fort Worth to perform a Chopin waltz on behalf of The Cliburn.

Fort Worth Opera

Fort Worth Opera Lesley Resident Artist Megan Koch, Soprano will perform Puccini’s famous “O mio babbino caro" as one of the FWSO's guest artists.

Texas Ballet Theater

Texas Ballet Theater dancers David Schrenk and Andre Silva will join the FWSO in a performance of "Maple Leaf Rag" by Scott Joplin.

Rules and Regulations

            The Fort Worth Symphony Orchestra (“FWSO”) is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code and is conducting the “Concert in the Gardens Raffle” to raise funds for charitable purposes. Below are the Rules & Regulations of the Raffle. By purchasing one or more Raffle tickets, the ticket purchaser agrees to be bound by these Rules & Regulations. FWSO reserves the sole right to interpret these Rules & Regulations and its decisions under these Rules & Regulations shall be final.

Eligibility

            To purchase a ticket, you must be 18 years of age or older at the time of the purchase. FWSO staff and members of its Board of Directors and the immediate family members of the staff and Board members are not eligible to win any Raffle prize. A ticket purchaser need not be present for the Raffle drawing in the evening of July 4, 2020.

Grand Prize. 2020 Cadillac XT5.

FWSO Symphonic Season Ticket prize.

$500 Cadillac Wines Gift Card Prize. (Winner must be 21 years of age or older).

Car Detailing Prize.

Pizza Party at Fort Worth Brewery & Pizza Prize.

Audra McDonald tickets prize.

Rock Springs Café dinner prize (Winner must be 21 years of age or older).

Tickets

            Raffle tickets cost $50 each or a pack of five tickets cost $200. There is no limit on the number of tickets purchased by one person. Only one name and one phone number are permitted on each ticket. FWSO requires one method of payment for all tickets purchased by the same purchaser. Any ticket that contains more than one name will not be considered and will not go into the Raffle drawing.

            Raffle ticket purchases are non-refundable. 

            Any defaced tickets will not be considered and will not go into the Raffle drawing.

            Any purchased ticket(s) in which the method of payment failed (e.g., dishonored check or rejected credit card authorization) will not be considered and will not go into the Raffle drawing.

            Any purchased tickets must be purchased and FWSO must be in possession of the ticket(s) by the drawing on July 4, 2020.

            FWSO assumes no responsibility for lost, misdirected, or late ticket purchases or any other failure to receive the ticket(s) and proper payment by the drawing on July 4, 2020.

            If FWSO receives any ticket(s) during or after the drawing on July 4, 2020, it will promptly return the tickets(s) purchase price to the purchaser.

Raffle Drawing

            The prizes will be awarded in the evening of July 4, 2020. Each Prize will be awarded separately. A Prize winner may win multiple prizes if individual raffle tickets are pulled for each prize; a raffle ticket will not be re-entered into the raffle after it has been drawn. If the 2020 FWSO Concerts In The Garden festival is canceled or postponed, this raffle drawing shall still take place on July 4, 2020.

            If the winner of a Prize is not present at the drawing, FWSO shall make a reasonable number of attempts to call the contact number on the winning ticket. If those attempts are unsuccessful and the winner does not otherwise contact FWSO by 5:00 p.m. on July 10, 2020, FWSO will award that Prize to another winner at that time by drawing from the tickets not drawn on July 4, 2020.

            If for whatever reason, a Prize winner does not collect the Prize by July 24, 2020 at 5:00 p.m., the FWSO shall hold another Raffle for that Prize at that time. If that subsequent winner does not for whatever reason collect that Prize by August 3, 2020, that Prize will be forfeited.

Requirements to Receive Prize

            The Grand Prize winner of the 2020 Cadillac XT5 may only be collected upon the winner satisfying all of the following:

            (1)       he or she must deliver to FWSO a sworn statement in which he or she warrants they meet the eligibility criteria;

            (2)       he or she must present valid proof of identity such as a drivers’ license that must match the name on the winning ticket;

            (3)       he or she must present the winning ticket;

            (4)       he or she must provide to the FWSO their Social Security number so that FWSO can complete IRS 2020 Tax Form W-2G and he or she must then sign that tax form; and

            (5)       he or she must remit to FWSO 24% of the fair market value of the 2020 Cadillac XT5 (fair market value of $46,415.00) less the amount of the winning ticket purchased by the winner, which will be transmitted to the IRS as income tax withholding as required by the Internal Revenue Code.

            All other Prizes other than the Grand Prize may only be collected upon the winner satisfying requirements (1), (2), and (3) above.

            The Grand Prize winner of the 2020 Cadillac XT5 shall be solely responsible for all applicable taxes and fees, including income tax and vehicle tax, title, license, and registration fees. The 2020 Cadillac XT5 shall be transferred to the winner “as is” and FWSO does not make or provide any representation, guarantee, or warranty, expressed or implied, in connection with the vehicle. FWSO further does not warrant the vehicle can be used for any particular purpose.

Odds of Winning

            The odds of winning a Prize will depend upon the number of tickets sold. If fewer tickets are sold, the chance of winning a Prize improves. Number of tickets sold is limited to 2,000.

General Terms and Conditions

            FWSO makes no representation or warranties express or implied about any of the Prizes.

            Purchase of one or more tickets does not qualify a deductible charitable contribution under current IRS rules.

            A winner of a Prize - especially the Grand Prize - should consult a tax advisor before collecting the Prize. FWSO makes no representations about the taxability associated with any Prize.

            Purchasers of one or more tickets consent to FWSO using their name and likeness in announcements and public statements concerning winners of one or more of the Prizes.

            By purchasing one or more tickets, each purchaser hereby holds harmless and releases FWSO and its officers, directors, trustees, donors, employees, and agents from any and all liability, penalties, claims, damages, costs, and expenses (including but not limited to attorneys’ fees) arising from or related to such purchase or the Raffle.

            A purchaser of one or more tickets shall solely have as a remedy for FWSO’s breach of any of these Rules & Regulations the return of the purchaser’s cost to purchase the tickets(s). Under no circumstances shall FWSO and its officers, directors, trustees, donors, employees, and agents be liable to any ticket purchaser for any consequential, special, or punitive damages.

            Any dispute arising between a ticket purchaser and FWSO arising out of or relating to the Raffle shall solely be heard and resolved by binding arbitration in Fort Worth, Texas before a single arbitrator and administered under the expedited procedures under the Commercial Arbitration Rules of the American Arbitration Association.
